Assuming you are the landlord, and you have prevailed in the case, the court will issue what is know as a writ of possession.  Once the landlord has the writ, he or she can then take it to the sheriff.  The sheriff then has the authority to forcibly remove the defendant from the premises.  The tenant, of course, has the option to leave before the eviction date.</p>
<p>The sheriff must <strong><a href="http://www.best-orange-county-eviction.com/orange-county-notice-to-tenants/">provide the tenant with a copy of the writ of possession</a></strong>.  The writ contains instructions on when the occupants need to move out and what will happen if they don’t.  The sheriff charges a fee to serve the writ of possession and the fee can be added to the <strong><a href="http://www.best-orange-county-eviction.com/orange-county-eviction-cost/">judgment the landlord may collection from the tenant.</a></strong></p>
<p>Once the occupants are served with the writ of possession, the tenant has 5 days to vacate.  If, by the end of the 5th day, the premises is still occupied, the sheriff will return to the residence and remove the tenants from the property.  If the occupant has left personal property at the residence the sheriff will confiscate it and put it into storage.   The tenant is charge with reasonable storage fees.</p>

<p>As an <strong><a href="http://www.best-orange-county-eviction.com/">Anaheim eviction attorney</a></strong>, I want to welcome you to our blog.  Here, we will give more specialized pieces of information that will hopefully answer some of your eviction and unlawful detainer questions.  First, we would like to start out with a basic introduction to <strong><a href="http://www.best-orange-county-eviction.com/the-orange-county-eviction-process/">the Orange County eviction process</a></strong>.</p>
<p>As I am sure you are aware, if a tenant does not move out of the unit after the <strong><a href="http://www.best-orange-county-eviction.com/orange-county-notice-to-tenants/">landlord has provided the tenant with the proper notice</a></strong>, the landlord may initiate an eviction or unlawful detainer proceeding.  In order to insure the tenant relinquishes possession, the landlord must file an eviction action in the Superior Court of Orange County.</p>
<p>In an Anaheim unlawful detainer, the landlord is designated as the Plaintiff while the tenant is designated as the Defendant.</p>
<p>As a landlord, you want to be very careful in the methods that you use to regain possession to your property.  If you use any method the code designates as unlawful, you could be subject to fines of up to $100 per day that the unlawful method was employed.  It is best to consult with an experiences Anaheim eviction attorney to find out what is best.</p>
<p>If the Superior Court determines that the landlord should prevail, the court will then issue a writ of possession (discussed in more detail in a later post).  The writ mandates that the Orange County sheriff, on a certain date and time, remove the tenant from the landlord&#8217;s property.  Now, this eviction is not instantaneous.  The tenant will provided 5 days to vacate the property voluntarily.  Once the 5 days have passed, the sheriff may lock out the tenant and return possession to the landlord.  The landlord must keep in mind that he or she cannot take possession of the unit until the sheriff has evicted the tenant.</p>
<p>At the eviction trial, the Court allows the parties to present evidence and explain the facts of the case.  If the tenant is able to prove that he or she has a valid reason for not paying rent, the Court will hold that the tenant is entitled to possession.  If the Superior Court determines that the tenant is correct,<strong><a href="http://www.best-orange-county-eviction.com/orange-county-eviction-cost/"> the landlord may be liable for the tenant’s costs</a></strong> as well as possibly his or her attorney fees.
